These Terms of Service ("Terms") are a binding agreement between you and Fixed LLC, a Tennessee limited liability company ("Fixed," "we," "us," or "our"), governing your access to and use of our iOS mobile application, our website at usefixed.app, and any related services we provide (collectively, the "Services").
By creating an account, accessing, or using any part of the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you may not access or use the Services.
We may update these Terms from time to time. We will post the revised Terms in the Services, update the "Last updated" date, and, where required by law, provide additional notice. Your continued use of the Services after we post changes constitutes acceptance of the updated Terms.
1. Eligibility and Accounts
By agreeing to these Terms, you represent that you are at least 18 years old (or the age of legal majority in your state of residence) and that you have the legal capacity to enter into these Terms.
You agree to provide accurate, current, and complete information when you create an account, and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been accessed without authorization, contact us immediately.
You may not use the Services for any unlawful or unauthorized purpose, and you may not, in your use of the Services, violate any law in your jurisdiction (including, without limitation, copyright laws and laws governing professional licensure). You may not transmit any virus, worm, or other malicious code through the Services. A breach or violation of these Terms may result in immediate suspension or termination of your access to the Services.
2. Description of Services
Fixed provides AI-assisted tools for diagnosing common home repair issues and for organizing the findings of professional home inspection reports. The Services include, depending on your account type and subscription:
- Repair diagnosis. You may submit a photograph or short video of an item you believe to be broken, along with a brief description, and our AI provider will return a suggested diagnosis, severity indication, possible temporary mitigations, suggested trade categories, and links to local contractors.
- Inspection priority reports. Real estate professionals may upload a third-party home inspection report (PDF). Our AI provider extracts what it identifies as the highest-priority items, quoting the inspector's own language. The professional may review and edit the extracted items, after which we generate a branded, downloadable report that lists the priority items and locally-sourced contractor referrals.
- Contractor lookup. We use the Google Places API to surface locally-licensed and locally-rated contractors near a property address you supply. Listings are sourced from third-party data and are not endorsed or vetted by Fixed.
3. The Nature of AI Output — Not Professional Advice
THIS SECTION IS IMPORTANT. PLEASE READ IT CAREFULLY.
Fixed is a software product that uses generative artificial intelligence to assist with repair and inspection tasks. Fixed is not a licensed home inspector, contractor, engineer, electrician, plumber, real estate broker, attorney, financial advisor, or other licensed professional. The Services do not provide professional advice.
AI-generated diagnoses, severity indications, suggested fixes, cost ranges (if any), and other content produced by the Services may be incomplete, inaccurate, out of date, or simply wrong. AI systems can and do make mistakes, including "hallucinating" content that has no basis in the input you provided. You should not rely on AI-generated content as the sole basis for any decision involving safety, structural integrity, environmental hazards, financial exposure, or legal rights. Always consult a qualified, licensed professional before acting on any AI-generated content, and obtain independent verification for anything material.
The inspection priority reports generated through the Services quote the language of a third-party inspector. Fixed does not independently inspect any property and does not verify, endorse, contradict, expand upon, or stand behind any statement made by an inspector. The accuracy and completeness of any inspection report is the responsibility of the inspector who authored it. Fixed's role is limited to extracting and re-presenting selected portions of the inspector's report and adding contractor referrals; Fixed does not provide a diagnosis or opinion of its own about the condition of any property.
Contractor listings displayed through the Services come from third-party sources. Fixed does not vet, license-check, insurance-verify, recommend, or guarantee any contractor. You are solely responsible for evaluating any contractor before engaging them, including verifying their license status, insurance, references, pricing, and suitability for your project.
4. User Content
"User Content" means any content you submit to the Services, including photographs, videos, descriptions, inspection reports, addresses, profile information, and edits you make to AI-generated output.
You retain all rights you have in your User Content. You grant Fixed a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, display, and otherwise use your User Content solely for the purpose of providing and improving the Services, including by transmitting it to our subprocessors (for example, our AI provider and our hosting provider). This license terminates when you delete the relevant User Content from the Services, except to the extent the content is retained in routine backups or where retention is required by law.
You represent and warrant that (a) you own or have the necessary rights to submit your User Content; (b) your submission does not infringe or misappropriate the rights of any third party; (c) for any inspection report you upload, you have the right to do so and to authorize Fixed to process it; and (d) your User Content does not contain anything unlawful, defamatory, harassing, or harmful.
Real estate professionals who upload inspection reports about properties are responsible for handling the underlying personal information of property owners, occupants, and inspectors in accordance with applicable law and any contracts that bind them. Fixed processes inspection reports as a service provider acting on the professional's behalf.
Generated reports are downloadable artifacts. Once you download or share a generated report, Fixed has no control over how the recipient uses or distributes it. You are responsible for any further distribution you authorize.
5. Subscriptions, Billing, and Refunds
Certain features of the Services are available only to users with an active paid subscription. As of the effective date of these Terms, paid subscriptions are sold exclusively through Apple's in-app purchase system on iOS. By purchasing a subscription:
- Your purchase is processed by Apple under Apple's standard terms. Fixed does not directly receive your payment card details.
- Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the renewal date through your Apple ID subscription settings.
- You can manage or cancel your subscription at any time through your iPhone's Settings → Apple ID → Subscriptions.
- Refunds for App Store purchases are governed by Apple's policies. To request a refund, you must contact Apple directly through reportaproblem.apple.com. Fixed does not control and cannot grant App Store refunds.
- Subscription tiers, pricing, included quantities (such as the number of inspection reports per month), and feature sets are described in the Services and may change. We will notify you of material changes in advance, as required by law and by Apple's rules.
If we offer team or pooled-quota plans (for example, a team plan that pools inspection-report credits among multiple agents), the account owner is responsible for managing seats. Adding a seat to a team plan does not grant the seated user a separate paid subscription.
If, in the future, we offer subscription products outside of Apple's in-app purchase system (for example, web-based subscriptions for commercial accounts), the billing terms applicable to those products will be presented at the point of purchase and will supplement these Terms.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose, or to solicit others to do so.
- Violate any international, federal, state, or local law, regulation, rule, or ordinance, including any law governing real estate brokerage, home inspection, contracting, or licensure.
- Infringe or violate the intellectual property rights or other rights of any party.
- Harass, abuse, defame, or discriminate against any person on any protected basis.
- Submit false or misleading information, including misrepresenting your professional license status.
- Upload inspection reports, photos, or other content you do not have the right to share.
- Upload viruses, malware, or any other code that may interfere with the Services.
- Use the Services to collect or track personal information about other people without authorization.
- Spam, phish, scrape, crawl, or otherwise interact with the Services in an automated way except as expressly permitted.
- Reverse engineer, decompile, or attempt to extract the source code of the Services, except to the extent applicable law prohibits us from restricting such activity.
- Resell, sublicense, or commercially exploit the Services or any output of the Services without our prior written consent.
We reserve the right to terminate your access to the Services for violating these Acceptable Use rules or for any other reason in our reasonable discretion.
7. Third-Party Services
The Services rely on third-party providers, including (without limitation) Apple, Anthropic, Google, Vercel, Supabase, Resend, Upstash, and RevenueCat. Your use of features that depend on a third-party provider is also subject to that provider's terms and policies. We are not responsible for the acts or omissions of third-party providers, except to the limited extent required by applicable law.
The Services may include links or references to third-party websites or services. We do not endorse and are not responsible for those third parties or their content.
8. Intellectual Property
The Services, including all software, designs, text, graphics, and trademarks (including the names "Fixed," the orange wrench logo, and the "FIXED." wordmark), are owned by Fixed LLC or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose, subject to these Terms. This license does not include any right to copy, modify, distribute, or create derivative works based on the Services, except as expressly permitted.
You may use generated reports for your own real estate business purposes, including sharing them with your clients. You may not remove Fixed branding from generated reports or repurpose them as a competing AI inspection product.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXED DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, FIXED DOES NOT WARRANT THAT (A) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE; (C) CONTRACTOR LISTINGS RETURNED THROUGH THE SERVICES WILL BE LICENSED, INSURED, AVAILABLE, OR SUITABLE; OR (D) ANY DEFECT OR ERROR WILL BE CORRECTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FIXED LLC OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, FIXED IS NOT RESPONSIBLE FOR ANY DAMAGES ARISING OUT OF (A) YOUR RELIANCE ON AI-GENERATED OUTPUT; (B) YOUR DECISION TO BUY, SELL, OR FORGO THE PURCHASE OF ANY PROPERTY; (C) THE QUALITY, COST, OR OUTCOME OF ANY WORK PERFORMED BY ANY CONTRACTOR YOU FIND THROUGH THE SERVICES; (D) THE ACCURACY OR COMPLETENESS OF ANY THIRD-PARTY HOME INSPECTION REPORT YOU UPLOAD; OR (E) THE ACTS OR OMISSIONS OF ANY THIRD-PARTY PROVIDER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXED'S TOTAL CUMULATIVE LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID FIXED IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) TWO HUNDRED FIFTY U.S. DOLLARS (US$250). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify, defend, and hold harmless Fixed LLC and our members, managers, officers, employees, contractors, and agents from and against any third-party claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services; (b) your User Content, including any inspection report you upload; (c) your breach of these Terms; (d) your violation of any law or the rights of any third party; or (e) any decision you or your client make in reliance on AI-generated output produced through the Services.
12. Termination
These Terms remain in effect until terminated by you or by us. You may terminate at any time by closing your account or by ceasing to use the Services. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Services.
Upon termination, your right to use the Services ends immediately. Sections of these Terms that by their nature should survive termination (including User Content licenses you have already granted, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of any arbitration provision (if and when one is added). The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to any later-added arbitration clause, the state and federal courts located in Tennessee will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Services, and you and Fixed each consent to the personal jurisdiction of those courts.
14. Changes to the Services
We may add, change, suspend, or discontinue any part of the Services at any time, including pricing, features, subscription tiers, and quotas. Where required by law or by our distribution platforms, we will provide advance notice of material changes.
15. Errors, Inaccuracies, and Omissions
The Services may occasionally contain typographical errors, inaccuracies, or omissions, including in product descriptions, pricing, marketing copy, and AI-generated output. We reserve the right to correct any such errors and to update or change information without prior notice.
16. Feedback
If you send us suggestions, ideas, or feedback about the Services, you agree we may use that feedback freely and without obligation to you, including by incorporating it into the Services. We are not required to keep feedback confidential.
17. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision.
These Terms, together with our Privacy Policy and any additional terms presented at the point of purchase or use, constitute the entire agreement between you and Fixed regarding the Services and supersede any prior or contemporaneous agreements between us regarding the Services.
